14th amendment and Justice for the insurrectionists

By now everybody, pretty much, knows that the DOJ is, in fact, investigating the insurrectionists who attacked the Capitol on Jan 6th and tried to violently interfere with the rule of law and the just election of Biden as President. Unfortunately, so far, only a couple hundred of the foot soldiers have been brought to any kind of justice at all. As of right now, the ringleaders, the true source of the sedition, have not faced any criminal investigations that we know about.

While Garland has made it clear that his department will follow the evidence all the way to the source, many see little action and are getting restless for justice to be done. Let’s not forget that the insurrectionists that appeared at the Capitol were just a drop in the buckle, and certainly not the true traitors who inspired the violence. For that, one would have to look at trump and many in the leadership of the Republican party who colluded with the lies about election fraud.

It seems, however, that Wisconsin is showing us another way. In the two sources listed, and even in Fox (I assume a local affiliate), there is a lawsuit being filed in Federal court appealing to the 14th Amendment and the section that was written to prevent former congresspersons that had defected to the Confederacy from ever being in Congress again.

At the time of the Civil War, they were rightly seen as traitors who tried to overturn the government of the United States and were unworthy of serving the United States ever again. The argument is being used to justify this lawsuit. Unfortunately, the Wisconsin lawsuit only applies to three persons from Wisconsin who actively worked to undermine confidence in the election and inflame the insurrectionists.

We need to consider, seriously, the idea of using the same logic, which I think is valid, in EVERY state that has these traitorous leaders in it. I suspect that would come close to being most of the 50 states.

Insurrectionists of this magnitude need to pay some sort of penalty….up to and including trump or they will try to do it again.
